General Terms and Conditions

Definitions:

Operator: Zeomineralproductos S.L. España 03430 Onil (Alicante) Calle Montserrat 7 (B67749804)
Website: the “instantprojectmanager.es”, “mabu.tech”, mabumanager.com, best-project-manager.com domains and subdomains, as well as any website operated under domain names owned by the Operator.
MABU App: any computer application developed by the Operator for phones or mobile devices.
User: any natural or legal person who visits the Website or installs and/or uses the Operator's application. Also, anyone who registers into the MABU Project Manager system.
MaBu System: the combination of the MABU App, the websites, and the MaBu project manager.
Services: services provided by the Operator in the MaBu System
MABU: The division of the Operator responsible for running this project

The Operator provides the following services:
- Within the Project Manager software


  1. Services listed under the "List of Services" menu item within the Project Manager software.
  2. Connection capability with the Colibri Mabu system.

A monthly fee must be paid for the services, except for some services which all Users can use for free.
The Operator will issue an invoice for the services after payment.

The MaBu system operates on a cloud basis. Internet connection and a browser are required to use it. 
It can be used on any operating system that provides an internet browser program/application.
The Operator regularly performs data backups of the stored data.
The Operator is not obliged to check the data recorded or uploaded into the system. However, random checks may be carried out.


It is forbidden to upload or record the following types of data into the system:


  1. Pornography
  2. Incitement to hatred
  3. Violence
  4. Fraud, deception
  5. Harassment
  6. Incitement, forbidden organization
  7. Arms trade
  8. Content infringing intellectual property


The following actions are strictly prohibited, and will result in immediate blocking of the account and IP address:

  1. Use of "Robot/Crawler" type browsing technologies
  2. Attempting to overload the website
  3. Any attempt to hack the website/application


The User who attempts these actions, or any activity that may violate the Operator's rights, is responsible for all damages caused.

The Operator will make every effort to ensure that the system operates error-free. However, they do not accept liability for damages caused by malfunctions or inappropriate internet connections.
The Operator performs regular, secure backups of stored data. This data will be stored for a maximum of 10 days. Within this period, the Operator can provide data restoration at the user's request.
The Operator is entitled to charge a fee for data restoration.


Data Management

The Operator does not transfer managed data to third parties, except with the User's consent.
Except for data provision at the request of the competent authority.
The Operator does not use data or information stored in the system for its own purposes and handles it as confidential.

“Phishing” and other fraudulent activities where theft and misuse of a person's identity occurs, mean that third parties impersonate employees or simulate the identity of an entity using fraudulent emails to obtain personal information through deception.

Task sharing by Users
Users have the possibility to share specific tasks with other MaBu Users for joint work purposes. Sharing a task is the User's decision, and the Operator does not accept liability for any damages that may arise from this.

Please keep the following suggestions in mind:

The Operator communicates exclusively via emails in the format “…@mabu.tech”, “….@mabu.es”, “…@mabumanager.com”, “…@zmv.es”
Therefore, be cautious with any electronic communication sent in the name of MABU from a domain other than those specified.
If you are not sure of the authenticity of the email sender, please write to the Operator's customer service: support@support.mabumanager.com,

Affiliate program

The Operator gives Users the opportunity to participate in the Affiliate program.
Users can invite other users. If the newly registered User purchases a service, the inviter is eligible for a rebate based on Appendix 1.
The rebate thus earned can be used to purchase services, or can be withdrawn against an invoice.
Users can view the current balance of their rebate at any time under the “Internal balance” menu item.
The rules and conditions of the rebate are detailed in Appendix 1.

Gift Coupons

The Operator is entitled to give gift coupons to users at its own discretion. These coupons can be used exclusively for the purchase of services.
For each purchase, they may be used up to a maximum of 50% of the amount to be paid. The Operator reserves the right to periodically change the maximum available discount.
Some coupons have an expiration date. These coupons can only be used within their validity period. Coupons must be validated before they can be used.

Dispute Resolution

In the case of disputes, the Operator strives for an amicable resolution.
If agreement cannot be reached, any dispute falls under the exclusive jurisdiction and competence of the courts of Madrid (Spain), without prejudice to the application of mandatory legal provisions.

Appendix 1

Affiliate program

The basic principle is that members use usable software, and 40% of the revenue is redistributed to the members.

This is done according to the following plan:

Each office registration is structured. Every member has an inviter.
You must enter your inviter’s code at registration. If you do not have such a code, the system will randomly place you in the structure.


1. Basic Affiliate program

Every registered member is eligible, regardless of whether they subscribe to any service.
After the purchase of each member they registered into the system, they will receive 5% commission from the net amount spent and paid
This amount is credited to the member’s internal account.

2. Direct Affiliate program

For each purchase made by a direct member, 30% of the net amount is immediately credited by the system. In this case, you only receive a rebate after direct members’ purchases, and you will not participate in the Pool program.

Each month you can choose whether you receive your rebate under the Sales Affiliate Program or the Direct Affiliate Program.
Your choice is always valid from the first to the last day of the following month.

Please note that you will only receive the rebate if you are eligible to participate in the “Affiliate program” at the time of closure.

3. Sales Affiliate program

1. Network rebate

Upon each service purchase, distribution of the paid net amount is based on the following chart:

Level 115%
Level 28%
Level 34%
Level 43%

This totals 30%.

The basis for redistribution is the net paid amount

This amount is credited to the internal account, immediately once the order receives the “Paid” status.
 The rebate can later be used for:

   1. Payment can be made against an invoice.
   2. To purchase services, up to a maximum of 50% of the total order amount.

Please note that you will only receive the rebate if you are eligible to participate in the “Affiliate program” at the time of crediting.


2. Pool rebate

10% of all payments are placed into a Pool fund each month. This fund is reset to zero every month.
Furthermore all commissions that are not credited in the Sales and Basic Affiliate programs due to the member not being active, are placed in this fund!

All users are eligible to earn Pool points for their activity performed in the system, regardless of whether they currently have a valid “Affiliate program” subscription.

Activities and points:

  1. Own purchase:  +20 Pool points per order
  2. Direct member purchases anything: +15 Pool points per order
  3. Direct member purchases a service
    including an “Affiliate program” subscription: +20 Pool points
  4. Any member on Level 2 purchases anything: +10 Pool points per order
  5. Any group member purchases anything:  +5 Pool points per order
  6. Direct member registration: +5 Pool points
  7. Registration within your group: +1 Pool point

The Pool program is closed monthly; each member receives a rebate in proportion to their Pool points.

The rule is as follows:

SUMPOOL = Total Pool fund collected in the given month (10% of net amount per order).
SUMPOINT = Total Pool points collected during the month.
Value of 1 Pool point = SUMPOOL/SUMPOINT
Your rebate = Value of 1 Pool point * Your number of points
Pool program closure: Last day of every month, 24:00.
Points and POOL fund are reset to zero every 1st of the month.

Each month you can choose whether you receive your rebate under the Sales Affiliate Program or the Direct Affiliate Program.
Your choice is always valid from the first to the last day of the month.

Please note that you will only receive the rebate if at the time of credit (last day of the month, 24:00) you are eligible to participate in the “Affiliate program.”

Conditions for participation in the Affiliate Program:
Purchase of at least one service that grants this right. You can find these services in the service list, marked as follows:  

Further rules regarding rebates

    1. The rebate accrued is available for use immediately.
    2. Minimum withdrawal limit for rebates against an invoice: net 50 EUR 
    3. The rebate can be withdrawn against an invoice at any time if the minimum withdrawal limit is reached. 
    4. When withdrawing against an invoice, the expected period for initiating the transfer is: 3-5 business days.
    5. The commission can also be used for service purchases. For each purchase, it can be used for up to 50% of the amount due.
        The Operator reserves the right to periodically change the maximum available discount.
